1. Agreement to Terms

Welcome to Aryorithm. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Aryorithm ("we," "us," or "our"), concerning your access to and use of our websites, including aryorithm.com, our software libraries XTorch and XInfer, our cloud service Ignition-Hub, and any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Services").

By accessing or using our Services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Services and you must discontinue use immediately.

2. User Accounts and Responsibilities

To access certain features of our Services, specifically the Ignition-Hub, you may be required to register for an account. You agree to:

  • Provide true, accurate, current, and complete information about yourself as prompted by the registration form.
  • Maintain and promptly update your registration data to keep it true, accurate, current, and complete.
  • Maintain the security of your password and accept all risks of unauthorized access to your account. You are responsible for all activities that occur under your account.
  • Notify us immediately of any suspected breach of security or unauthorized use of your account.

You must be at least 13 years old to create an account.

3. Software Libraries (XTtorch & XInfer)

Our software libraries, XTtorch and XInfer, are made available to you under the terms of their respective open-source licenses ([e.g., MIT License, Apache License 2.0 - SPECIFY YOUR CHOSEN LICENSE HERE]). By using, copying, modifying, or distributing the libraries, you agree to the terms and conditions of the applicable open-source license.

4. Ignition-Hub Cloud Service & User Content

Our Ignition-Hub service allows you to upload, store, and process your TensorRT engine files and other models ("User Content").

  • Your Ownership: You retain full ownership of your User Content. We do not claim any ownership rights in any of the models or data you upload to the Ignition-Hub.
  • License Grant to Us: By uploading User Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, run, reproduce, and display your User Content for the limited purpose of operating, providing, and improving the Services. This license ends when you delete your User Content or your account.
  • Your Responsibility: You are solely responsible for your User Content and the consequences of uploading and processing it. You represent and warrant that you have all the necessary rights to your User Content and that its use does not violate any laws or rights of third parties.

5. Acceptable Use Policy

You agree not to use the Services to:

  • Upload or transmit any User Content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
  • Violate any applicable local, state, national, or international law.
  • Engage in any activity that interferes with or disrupts the Services (or the servers and networks which are connected to the Services).
  • Attempt to gain unauthorized access to any portion of the Services or any other systems or networks connected to the Services.
  • Use the Services for any purpose that competes directly with the Services we offer.
  • Reverse engineer, decompile, or otherwise attempt to discover the source code of the Services, except for the components released under an open-source license.

6. Payments, Subscriptions, and Refunds

  • Billing: If you purchase a paid subscription to our Ignition-Hub service, you agree to pay all fees at the prices then in effect for your chosen plan. You authorize us to charge your chosen payment provider.
  • Recurring Billing: Your subscription will automatically renew at the end of each billing cycle unless you cancel it. You may cancel your subscription at any time through your account dashboard. The cancellation will take effect at the end of the current billing period.
  • Price Changes: We reserve the right to change our subscription plan prices. We will provide you with reasonable prior notice of any price changes.
  • Refunds: Payments are non-refundable except as required by law or as explicitly stated in our refund policy.

7. Intellectual Property Rights

Excluding your User Content and the components governed by open-source licenses, the Services and all of their content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Aryorithm, its licensors, or other providers of such material and are protected by copyright, trademark, patent, and other intellectual property laws.

8. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by using the account deletion feature in your dashboard or by contacting us. Upon termination, your right to use the Service will immediately cease, and we may delete your account and all associated User Content.

8. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ARYORITHM MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND HEREBY DISCLAIMS AND NEGATES ALL OTHER WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR OTHER VIOLATION OF RIGHTS.

10. Limitation of Liability

IN NO EVENT SHALL ARYORITHM, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your State/Country], without regard to its conflict of law provisions.

12. Changes to Terms
